This Privacy Policy describes how Cliptalk AI, Inc. ("Cliptalk," "we", "us" or "our") processes personal information that we collect through our digital or online properties or services that link to this Privacy Policy (including as applicable, our website, mobile application, social media pages, marketing activities, live events, and other activities described in this Privacy Policy) (collectively, the "Service"). Cliptalk may provide additional or supplemental privacy policies to individuals for specific products or services that we offer at the time we collect personal information.

Cliptalk provides a set of tools and services for creating, editing, and generating content. This Privacy Policy does not apply to information that we process on behalf of our enterprise customers (such as businesses and other organizations) while providing the Cliptalk platform and services to them. Our use of information that we process on behalf of our business customers may be governed by our agreements with such customers. If you have concerns regarding your personal information that we process on behalf of a business customer, please direct your concerns to that enterprise customer.

Personal information we collect

Information you provide to us

Personal information you may provide to us through the Service or otherwise includes:

  • Contact data: such as your first and last name, email address, billing and mailing addresses, professional title and company name, and phone number.
  • Demographic data: such as your city, state, country of residence, postal code, and age.
  • Profile data: such as the username and password that you may set to establish an online account on the Service, photograph or picture, preferences, and any other information that you add to your account profile.
  • Communications data: based on our exchanges with you, including when you contact us through the Service, social media, or otherwise.
  • Transactional data: such as information relating to or needed to complete your orders on or through the Service, including order numbers and transaction history.
  • Marketing data: such as your preferences for receiving our marketing communications and details about your engagement with them.
  • User-generated content data: such as photos, images, music, videos, comments, questions, messages, works of authorship, and other content or information that you generate, transmit, submit to us as part of a contest or live event, or otherwise make available on the Service, as well as associated metadata.

Metadata includes information on how, when, where, and by whom a piece of content was collected and how that content has been formatted or edited. Metadata also includes information that users can add or can have added to their content, such as keywords, geographical or location information, and other similar data.

If you use certain of our features, such as our Portrait Generator and Voice Cloning features, we and our service providers may also collect scans of faces or voiceprints from user-generated content data.

Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Automatic data collection

We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, such as:

  • Device data: such as your computer or mobile device's operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.
  • Online activity data: such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
  • Communication interaction data: such as your interactions with our email, text or other communications (e.g., whether you open and/or forward emails) -- we may do this through use of pixel tags (which are also known as clear GIFs), which may be embedded invisibly in our emails.

Cookies

Some of our automatic data collection is facilitated by cookies and similar technologies. We will also store a record of your preferences in respect of the use of these technologies in connection with the Service.

Cookies and similar technologies

Some of the automatic collection described above is facilitated by the following technologies:

  • Cookies: which are small text files that websites store on user devices and that allow web servers to record users' web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites include both "session cookies" that are deleted when a session ends, "persistent cookies" that remain longer, "first party" cookies that we place and "third party" cookies that our third-party business partners and service providers place.
  • Local storage technologies: like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
  • Web beacons: also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

Data about others

We may offer features that help users invite their friends or contacts to use the Service, and we may collect contact details about these invitees so we can deliver their invitations. Please do not refer someone to us or share their contact details with us unless you have their permission to do so.

How we use your personal information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

Service delivery and operations

We may use your personal information to:

  • Provide, operate, and improve the Service and our business;
  • Personalize the Service, including remembering the devices from which you have previously logged in and remembering your selections and preferences as you navigate the Service;
  • Establish and maintain your user profile on the Service;
  • Facilitate your invitations to friends who you want to invite to join the Service;
  • Enable security features of the Service, such as by sending you security codes via email and remembering devices from which you have previously logged in;
  • Communicate with you about the Service, including by sending Service-related announcements, updates, security alerts, and support and administrative messages;
  • Communicate with you about events or contests in which you participate;
  • Understand your needs and interests, and personalize your experience with the Service and our communications; and
  • Provide support for the Service, and respond to your requests, questions, and feedback.

Product improvement

As part of our efforts to improve the Service and our Cliptalk's products and services, we may create aggregated, de-identified and/or anonymized data from personal information we collect. We make personal information into de-identified or anonymized data by removing information that makes the data personally identifiable to you. We may use this aggregated, de-identified or otherwise anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business and will not attempt to reidentify any such data.

Marketing

We and our service providers may collect and use your personal information for marketing and advertising purposes:

  • Direct marketing: We may send you direct marketing communications and may personalize these messages based on your needs and interests. You may opt-out of our marketing communications as described in the Opt-out of marketing section below.
  • Events, promotions, and contests: We may use your personal information to administer promotions and contests, communicate with you about promotions or contests in which you participate, contact or market to you after collecting your personal information at an event.

Service improvement and analytics

We may use your personal information to analyze your usage of the Service, improve the Service, improve the rest of our business, help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails, and to develop new products and services.

Compliance and protection

We may use your personal information to:

  • Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas, investigations, or requests from government authorities;
  • Protect our, your, or others' rights, privacy, safety, or property (including by making and defending legal claims);

  • Enforce the terms and conditions that govern the Service; and

  • Technical operation: To allow the technical operation of the Service, such as by remembering your selections and preferences as you navigate the site, and whether you are logged in when you visit password-protected areas of the Service.
  • Functionality: To enhance the performance and functionality of our services.
  • Analytics: To allow us to understand how users use the Service, such as by tracking which pages are visited and how users interact with those pages.
  • Advertising and marketing: To allow us to deliver, tailor, and measure the effectiveness of advertising or marketing campaigns.

We do not share personal information with third parties for their own marketing purposes. However, we may share personal information with:

Service providers

Companies and individuals that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, and website analytics services). These third parties may use your personal information only as directed by Cliptalk and in a manner consistent with this Privacy Policy and any other applicable confidentiality and security measures.

Advertising partners

Third-party advertising companies for the interest-based advertising purposes described above, including for the interest-based advertising purposes described above. We do not sell your personal information to these companies.

Business and marketing partners

Third parties with whom we partner for business, marketing and other purposes. These third parties may use your personal information only as directed by Cliptalk and in a manner consistent with this Privacy Policy and any other applicable confidentiality and security measures.

Professional advisors

Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others

Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Business transfers

We may share personal information with relevant third parties in connection with any corporate transaction, such as a merger, sale of company assets or shares (including at bankruptcy or similar proceedings), reorganization, financing, change of control or acquisition of all or a portion of our business by another company, or joint venture. The receiving party in such a transaction may use your personal information as described in this Privacy Policy.

Your choices

In this section, we describe the rights and choices available to all users. Users who are located in Europe or California can find additional information about their rights below.

Opt-out of marketing communications

You may opt-out of marketing-related communications by following the opt-out or unsubscribe instructions at the bottom of the email or by contacting us as set out in the "How to contact us" section below. You may continue to receive service-related and other non-marketing communications.

Opt-out of cookie-based tracking

Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. If you do not accept our cookies, you may experience inconvenience in your use of the Service. Do Not Track

Some Internet browsers offer a "Do Not Track" feature that lets you send a signal to websites you visit indicating that you do not want to be tracked. However, there is currently no universal standard for how websites should respond to such signals. Therefore, we do not currently respond to "Do Not Track" signals.

Access, update, or delete your information

If you are a registered user of the Service, you may access, update, or delete certain personal information associated with your account by logging into your account settings or by contacting us using the contact information provided below. If you wish to deactivate or delete your account, please email us at privacy@cliptalk.pro, but note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of your information for a certain period of time.

Online tracking

We do not currently recognize or respond to browser-initiated Do Not Track signals.

Location information

You can prevent your device from sharing precise location information at any time through your device's operating system settings.

Communications preferences

You can stop receiving promotional email communications from us by clicking on the "unsubscribe link" provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt-out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices).

Cookies and similar technologies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Service.

Security

We take reasonable measures to help protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no data transmission over the internet or wireless network can be guaranteed to be 100% secure. Therefore, while we strive to protect your personal information, you acknowledge that:

There are security and privacy limitations inherent to the internet, which are beyond our control. The security, integrity, and privacy of any and all information and data exchanged between you and us through the Service cannot be guaranteed. Any such information and data may be viewed or tampered with in transit by a third party, despite our best efforts. Data Retention We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax, or accounting requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

International Data Transfers

Your information, including personal information, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal information, to the United States and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Children's Privacy

The Service is not directed to anyone under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us. If we become aware that we have collected personal information from children without verification of parental consent, we take steps to remove that information from our servers.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
